CloudSave Terms and Conditions

Axsa Technologies (“we,” “us,” or “our”), an Indian company headquartered in Mumbai, Maharashtra, India, operates CloudSave, a cloud storage and content-sharing platform. These Terms and Conditions (“Terms”) govern your use of CloudSave’s services, including cloud storage, file-sharing, channels, CloudSave Coins, subscription plans, premium/pro subscriptions, and the monetization program (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms, which incorporate our Privacy Policy, Auto-Renewal Agreement, CloudSave Coins Terms, Refund Policy, Channel Policy, Monetization Policy, and DMCA Policy. If you do not agree, please do not use the Services.
1. Eligibility
- You must be at least 13 years old to use the Services. Users under 18 require parental or guardian consent.
- By using the Services, you represent that you meet these eligibility requirements and comply with applicable laws.
2. Account Registration
- Account Creation: To access certain features, you must create an account with accurate and complete information via the CloudSave app or website.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
- Account Termination: We may suspend or terminate your account for violations of these Terms, fraudulent activity, or as required by law, with notice where feasible.
3. Cloud Storage and File Sharing
- Storage: CloudSave provides cloud storage for files, media, and documents (“Content”). Storage limits depend on your plan:
- Free Plan: Limited storage (e.g., 5GB, subject to change).
- Subscription Plan (Ad-Free): Monthly plan removing interstitial ads, app open ads, and banner ads (see Section 5.1).
- Premium/Pro Plans: Monthly or annual plans for enhanced features (e.g., increased storage, priority uploads) with reduced or no ads (see Section 5.2).
- Sharing: You may share Content with users or non-users via links or direct transfers, subject to these Terms.
- Ownership: You retain ownership of your Content but grant us a worldwide, non-exclusive, royalty-free license to store, process, and transmit your Content to provide the Services.
- Prohibited Content: You may not upload, store, or share Content that:
- Violates intellectual property rights, privacy rights, or applicable laws.
- Contains malware, viruses, or harmful code.
- Is obscene, defamatory, or promotes violence, hate, or illegal activities.
4. Channels
Channels allow users to broadcast or share Content with subscribers, as detailed in our Channel Policy.
4.1 Creation and Management
- Creation: Users can create public or private channels to share Content (e.g., text, images, videos, documents) via the CloudSave app or website.
- Moderation: You are responsible for moderating your channel’s Content and ensuring compliance with our Channel Policy.
- Subscribers: Public channels are open to all users; private channels restrict access to approved subscribers.
4.2 Prohibited Activities
You may not use channels to:
- Share illegal content, such as copyrighted material without authorization, obscene material, or content promoting illegal activities.
- Promote harmful behavior, including self-harm, violence, or discrimination based on race, gender, religion, caste, sexual orientation, or other protected characteristics.
- Spread harmful misinformation, such as unverified health claims or election disinformation.
- Engage in spam, scams, or phishing (e.g., unsolicited messages or fraudulent schemes).
- Exploit or endanger minors, including sharing inappropriate or explicit material.
- Create new channels to bypass suspensions or bans.
- Impersonate others or misrepresent your identity.
- Share others’ personal data without consent, violating applicable privacy laws.
4.3 Enforcement
- We may monitor channels and take actions (e.g., content removal, channel suspension, or account termination) for violations.
- Users can report violations via in-app tools or [email protected]. Appeals can be submitted within 7 days via email.
5. Subscription Plans and Premium/Pro Subscriptions
5.1 Subscription Plan (Ad-Free)
- Details: A monthly subscription that removes interstitial ads, app open ads, and banner ads (ads that cover the entire screen or appear as static banners). Native ads, rewarded ads, and offerwalls remain unaffected and will continue to be displayed.
- Auto-Renewal: Auto-renews via Google Play Store or Apple App Store, as per our Auto-Renewal Agreement.
- Purchase Options: Can be purchased via Google Play Store, Apple App Store, the CloudSave redeem page, or CloudSave Coins.
5.2 Premium/Pro Plans
- Premium Plans:
- Available monthly or annually, offering enhanced features (e.g., increased storage, priority uploads).
- Reduces the frequency of interstitial ads, app open ads, and banner ads by 50%. Native ads, rewarded ads, and offerwalls remain unaffected and will continue to be displayed.
- Pro Plans:
- Available monthly or annually, offering all premium features plus 100% ad-free experience for interstitial ads, app open ads, and banner ads. Native ads, rewarded ads, and offerwalls remain unaffected and will continue to be displayed.
- Auto-Renewal: Both premium and pro plans auto-renew via Google Play Store or Apple App Store, as per our Auto-Renewal Agreement.
- Purchase Options: Can be purchased via Google Play Store, Apple App Store, the CloudSave redeem page, or CloudSave Coins.
5.3 Cancellation and Refunds
- Cancellation: Subscriptions can be canceled via platform settings (Google Play Store or Apple App Store), with access continuing until the billing cycle ends, as per our Auto-Renewal Agreement.
- Refunds: Subscriptions are generally non-refundable, except for technical errors, unauthorized charges, or non-delivery, as per our Refund Policy.
6. CloudSave Coins
As per our CloudSave Coins Terms:
- Purpose: Virtual currency for redeeming subscription plans, premium/pro subscriptions, channel subscriptions, or other in-app features.
- Acquisition: Purchased via Google Play Store or Apple App Store or earned through promotions (e.g., ads, offerwalls).
- Restrictions: Coins have no real-world value, are non-transferable, non-refundable (except as per our Refund Policy), and cannot be sold or traded.
- Forfeiture: Coins are forfeited upon account termination or 12 months of inactivity, subject to applicable laws.
7. Channel Monetization Program
As per our Monetization Policy, eligible channels can earn revenue.
7.1 Eligibility
To monetize, your channel must:
- Be at least 90 days old.
- Have no active copyright claims, as per our DMCA Policy.
- Have at least 1,000 active subscribers (engaged within the last 30 days).
- Be linked to a premium or pro account purchased directly via Google Play Store or Apple App Store payment methods. Premium/pro subscriptions purchased through the redeem page or via CloudSave Coins are not eligible for channel monetization.
- Post content regularly (at least once every 30 days).
- Comply with our Channel Policy and provide accurate payment details (e.g., PAN for tax purposes).
7.2 Revenue
- Earnings Cap: Up to $50 USD per month, based on:
- Device Location: Subscriber device locations (e.g., higher earnings in US/EU).
- Subscriber Country: Subscriber residency, affecting revenue due to economic differences.
- Engagement: Views, likes, comments, shares, and subscriber retention.
- Subscription Revenue: CloudSave Coins paid for premium channel content.
- Content Quality: Relevance, originality, and posting frequency.
- Ad Impressions: If applicable, ad views by subscribers (excluding native ads, rewarded ads, and offerwalls, which are not affected by subscription plans).
- Other: Seasonal trends or platform campaigns.
- Calculation: We determine factor weightings and may adjust them for fairness.
7.3 Payouts
- Schedule: Paid monthly within 30 days, if earnings exceed $10 USD.
- Methods: Bank transfer, UPI, or other methods, with potential fees disclosed.
- Taxes: Subject to GST and income tax (TDS may apply). You must provide a valid PAN and report earnings to tax authorities.
- Forfeiture: Earnings may be withheld for violations.
7.4 Prohibited Practices
You may not:
- Manipulate metrics (e.g., using bots or fake accounts).
- Post prohibited content, as per our Channel Policy.
- Engage in fraud or misrepresentation.
- Evade monetization restrictions.
8. Intellectual Property
- CloudSave’s IP: All software, designs, and trademarks are our property or our licensors’.
- User Content: You must ensure your Content does not infringe third-party rights. Copyright claims are handled per our DMCA Policy, with potential content removal or account termination for repeat infringers.
- DMCA Compliance: We process copyright infringement notices and counter-notifications, as outlined in our DMCA Policy.
9. Privacy
Your use of the Services is subject to our Privacy Policy, which governs data collection, use, and protection under the Digital Personal Data Protection Act, 2023. By using the Services, you consent to our data practices.
10. Refunds
As per our Refund Policy:
- Non-Refundable: Subscription plans, premium/pro subscriptions, channel subscriptions, and CloudSave Coins are generally non-refundable, except for technical errors, unauthorized charges, or non-delivery.
- Process: Requests must be submitted within 24 hours to [email protected] or via platform refund channels (Google Play Store or Apple App Store).
11. User Conduct
- Compliance: You must use the Services in accordance with Indian and international laws.
- Prohibited Actions: You may not:
- Hack, disrupt, or interfere with the Services.
- Scrape data using automated tools without permission.
- Impersonate others or engage in fraud.
- Use Coins or monetization features unlawfully.
12. Termination
- By You: You may delete your account at any time via the app or website.
- By Us: We may suspend or terminate access for violations, illegal activities, or at our discretion with notice where feasible.
- Effect: Termination ends access, deletes Content, and forfeits Coins and monetization earnings, subject to applicable laws.
13. Disclaimers
- As-Is Basis: The Services are provided “as is” without warranties, express or implied, including merchantability or fitness for a particular purpose.
- Availability: We do not guarantee uninterrupted or error-free access.
14. Limitation of Liability
- Scope: To the maximum extent permitted by law, Axsa Technologies, its affiliates, officers, directors, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages (e.g., loss of profits, data, or use) arising from the Services, whether in contract, tort, or otherwise.
- Liability Cap: Our total liability is limited to the greater of $20 USD or 100% of any amount you have paid under your current service plan (e.g., subscription, premium/pro plan, or Coin purchases) in the 12 months preceding the claim.
- Exceptions: This does not apply to liability from gross negligence, willful misconduct, or violations of applicable consumer protection laws.
15. Indemnification
You agree to indemnify and hold Axsa Technologies, its affiliates, officers, directors, employees, and agents harmless from claims, losses, damages, or expenses (including legal fees) arising from your use of the Services, your Content, or your violation of these Terms or applicable laws.
16. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of the State of Maharashtra, India, without regard to conflict of law principles.
- Dispute Resolution: Disputes will be resolved through binding arbitration in Mumbai, in accordance with the Arbitration and Conciliation Act, 1996, with a single arbitrator and proceedings in English, except for matters eligible for consumer courts under the Consumer Protection Act, 2019.
17. Changes to These Terms
- It is your responsibility to review these Terms periodically for updates by visiting the CloudSave website or app.
- Continued use of the Services after changes constitutes acceptance of the updated Terms.
18. Consumer Protection
- Under the Consumer Protection Act, 2019, you have rights to fair treatment, accurate information, and redressal for unfair practices.
