Axsa Technologies (“we,” “us,” or “our”), an Indian company headquartered in Mumbai, Maharashtra, India, operates CloudSave, a cloud storage and content-sharing platform that allows users to store, share, and send files, media, and documents, and create channels for broadcasting content (“Services”). This DMCA Policy outlines our procedures for addressing copyright infringement claims under the Digital Millennium Copyright Act of 1998 (DMCA) and applicable Indian laws, including the Indian Copyright Act, 1957. By using our Services, you agree to comply with this DMCA Policy, as well as our Terms of Service, Privacy Policy, Auto-Renewal Agreement, CloudSave Coins Terms, Refund Policy, Channel Policy, and Monetization Policy.

1. Purpose of This Policy

This policy establishes the process for:

  • Submitting copyright infringement notifications to report unauthorized use of copyrighted material on CloudSave.
  • Responding to such notifications, including removing or disabling access to allegedly infringing content.
  • Allowing users to submit counter-notifications if they believe their content was removed in error.
  • Addressing repeat infringers to prevent ongoing violations.

We are committed to protecting intellectual property rights while maintaining a fair process for all users, in compliance with the DMCA and Indian laws.

2. Scope of This Policy

This DMCA Policy applies to all content uploaded, stored, shared, or posted on CloudSave, including:

  • Files, media, and documents in cloud storage or shared via links.
  • Content posted on user-created channels, whether public or private.
  • Any other user-generated content accessible through the Services.

3. Reporting Copyright Infringement (DMCA Notice)

If you are a copyright owner or an authorized representative and believe that content on CloudSave infringes your copyright, you may submit a DMCA takedown notice to our Designated Copyright Agent. Your notice must include the following information, as required by the DMCA:

  • Accuracy Statement: A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

4. Action on DMCA Notices

Upon receiving a valid DMCA notice, we will:

  • Review: Assess the notice for completeness and compliance with DMCA requirements.
  • Remove or Disable Access: Promptly remove or disable access to the allegedly infringing content, in accordance with the DMCA and Indian laws.
  • Notify the User: Inform the user who posted the content (if identifiable) of the removal, providing a copy of the notice and instructions for submitting a counter-notification.
  • Record: Maintain a record of the notice for legal and compliance purposes, as outlined in our Privacy Policy.

We may also take additional actions, such as suspending channel features or monetization privileges, depending on the severity of the violation, as per our Terms of Service and Channel Policy.

5. Counter-Notifications

If you believe your content was removed or disabled in error (e.g., due to misidentification or fair use), you may submit a DMCA counter-notification to our Designated Copyright Agent. Your counter-notification must include:

  • Identification of the Removed Content: A description of the content that was removed or disabled, including its location on CloudSave (e.g., URL or file details).
  • Your Contact Information: Your name, address, phone number, and email address.
  • Good Faith Statement: A statement that you have a good faith belief that the content was removed or disabled as a result of a mistake or misidentification.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the courts in Mumbai, Maharashtra, India, and will accept service of process from the complainant or their agent.
  • Accuracy Statement: A statement, under penalty of perjury, that the information in your counter-notification is accurate.
  • Signature: Your physical or electronic signature.

6. Action on Counter-Notifications

Upon receiving a valid counter-notification, we will:

  • Forward: Provide a copy of the counter-notification to the original complainant.
  • Wait Period: Allow the complainant 10 business days to notify us of a filed court action to restrain the alleged infringement.
  • Restore Content: If no court action is reported within 10 business days, we may, at our discretion, restore the content or re-enable access, unless other violations of our policies apply.
  • Notify: Inform the user and complainant of the outcome.

Restoration is subject to compliance with our Terms of Service, Channel Policy, and applicable laws. We may decline to restore content if we believe it violates other policies or laws.

7. Repeat Infringers

  • Policy: Users who repeatedly infringe copyrights may have their CloudSave account suspended or terminated, as determined by us in accordance with the DMCA and our Terms of Service.
  • Criteria: A user may be considered a repeat infringer if they receive multiple valid DMCA notices or engage in persistent unauthorized use of copyrighted material.
  • Consequences: Termination may result in the loss of access to the Services, deletion of content, and forfeiture of CloudSave Coins or monetization earnings, as per our CloudSave Coins Terms and Monetization Policy.

8. Misrepresentations

  • Liability: Submitting a false DMCA notice or counter-notification may result in liability for damages, including legal fees, under the DMCA and applicable laws.
  • Action: We may suspend or terminate accounts of users who knowingly submit false claims or counter-notifications, as per our Terms of Service.

9. Privacy and Data Handling

  • Data Collection: DMCA notices and counter-notifications may include personal data (e.g., names, contact details), which we process in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023 (DPDP Act).
  • Data Sharing: We may share notice or counter-notification details with the affected user, complainant, or legal authorities, as required by law or to resolve the claim.
  • Retention: DMCA-related data is retained for 7 years to comply with legal obligations, as outlined in our Privacy Policy.
