Axsa Technologies (“we,” “us,” or “our”), an Indian company headquartered in Mumbai, Maharashtra, India, operates CloudSave, a cloud storage and content-sharing platform. This CloudSave Coins Terms document governs the acquisition, use, and restrictions of CloudSave Coins (“Coins”), a virtual currency used within the CloudSave application (“Services”) to redeem premium features, subscription plans, premium/pro subscriptions, and channel subscriptions. By acquiring or using Coins, you agree to be bound by these CloudSave Coins Terms, in addition to our Terms of Service, Privacy Policy, Auto-Renewal Agreement, Refund Policy, Channel Policy, Monetization Policy, and DMCA Policy.

1. Overview of CloudSave Coins

  • Purpose: CloudSave Coins are a virtual currency used exclusively within the CloudSave platform to purchase or redeem:
    • Subscription Plans: Monthly plans for ad-free access.
    • Premium/Pro Subscriptions: Monthly or annual subscriptions for enhanced features, such as increased storage, priority uploads, or advanced sharing options.
    • Channel Subscriptions: Access to premium content on user-created channels, as per our Channel Policy.
    • Other in-app features or services, as specified in the CloudSave app.
  • No Real-World Value: Coins have no monetary value outside the CloudSave platform, are non-transferable, and cannot be redeemed for cash or any other currency.
  • Platform Availability: Coins are available for use in the CloudSave mobile applications on Android (via Google Play Store) and iOS (via Apple App Store) and on the CloudSave website, subject to platform policies.

2. Acquiring CloudSave Coins

Coins can be acquired through the following methods:

  • Purchase:
    • Coins are available for purchase via in-app transactions through the Google Play Store or Apple App Store.
    • Prices are displayed in the app at the time of purchase, inclusive of applicable taxes (e.g., Goods and Services Tax, GST).
    • Payment is processed using the payment method linked to your platform account, subject to Google Play Store or Apple App Store terms.
  • Promotional Activities:
    • Coins may be earned through promotional activities, such as watching advertisements, completing offerwalls, or participating in campaigns, as offered by CloudSave or its partners.
    • Promotional Coins are subject to availability and may have specific terms (e.g., expiration dates or usage limits).
  • Eligibility: You must have a registered CloudSave account and comply with our Terms of Service to acquire Coins. Users under 18 require parental consent for purchases.

3. Using CloudSave Coins

  • Redemption: Coins can be used to:
    • Subscribe to monthly subscription plans for ad-free access.
    • Purchase monthly or annual premium/pro subscriptions for enhanced features.
    • Subscribe to premium channels for exclusive content, as per our Auto-Renewal Agreement and Channel Policy.
    • Unlock other in-app features or services, as specified in the app.
  • Auto-Renewal for Channel Subscriptions: As per our Auto-Renewal Agreement, channel subscriptions auto-renew monthly if your CloudSave wallet has sufficient Coins; otherwise, the subscription lapses, requiring manual resubscription.
  • Balance Management: Your Coin balance is displayed in your CloudSave wallet within the app. You are responsible for ensuring sufficient Coins for intended transactions.
  • Non-Transferable: Coins are tied to your CloudSave account and cannot be transferred, gifted, or shared with other users or accounts.

4. Restrictions on CloudSave Coins

To maintain the integrity of the Services, the following restrictions apply:

  • No Cash Value: Coins cannot be exchanged for cash, converted to real-world currency, or used outside the CloudSave platform.
  • Non-Refundable: Purchased or earned Coins are generally non-refundable, except as outlined in our Refund Policy (e.g., for technical errors or unauthorized charges).
  • No Trading or Selling: You may not sell, trade, barter, or otherwise exchange Coins for real-world goods, services, or currency, whether inside or outside the platform.
  • Fraudulent Acquisition: Acquiring Coins through unauthorized means (e.g., hacking, fraud, or exploiting glitches) is prohibited and may result in account suspension or termination.
  • Expiration: Promotional Coins may have expiration dates, as specified at the time of issuance. Purchased Coins do not expire while your account remains active.
  • Forfeiture: Coins may be forfeited upon:
    • Account termination, whether voluntary or due to violations of our Terms of Service.
    • Discontinuation of the CloudSave platform or Coin program, with notice where feasible.
    • Inactivity of your account for 12 months, subject to applicable laws.

5. Refunds for CloudSave Coins

  • Eligibility: Refunds for purchased Coins may be considered for:
    • Purchase Errors: Duplicate charges or incorrect Coin packages, reported within 24 hours.
    • Non-Delivery: Coins not credited to your wallet due to a technical issue.
    • Unauthorized Charges: Charges made without your consent, reported promptly.
  • Promotional Coins: Earned Coins (e.g., via ads or offerwalls) are non-refundable.
  • Process: Refund requests must be submitted within 24 hours to [email protected], including your account email, transaction ID, and issue details. Approved refunds may be issued as:
    • Monetary refunds to your original payment method (for purchased Coins).
    • Coin credits to your CloudSave wallet (for channel subscriptions or technical errors).
  • Platform Refunds: For purchases made via Google Play Store or Apple App Store, you may also request refunds through their respective platforms, subject to their policies, as outlined in our Refund Policy.

6. Privacy and Data Handling

  • Data Collection: We collect data related to Coin purchases and usage (e.g., transaction IDs, wallet balance, subscription details) to process transactions and provide the Services, as outlined in our Privacy Policy.
  • Data Sharing: Limited data may be shared with payment processors (e.g., Google Play Store, Apple App Store) or analytics providers to facilitate transactions or improve the Services, in compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act).
  • Retention: Transaction data is retained for 7 years to comply with Indian tax laws, as detailed in our Privacy Policy.

7. Termination and Suspension

  • By You: You may stop using Coins by ceasing to purchase or redeem them or by deleting your CloudSave account, as per our Terms of Service.
  • By Us: We may suspend or terminate your access to Coins for:
    • Violations of these CloudSave Coins Terms, our Terms of Service, or other policies.
    • Fraudulent or unauthorized Coin acquisition or use.
    • Legal or regulatory requirements, with notice where feasible.
  • Effect of Termination: Upon account termination, any unused Coins are forfeited and cannot be refunded, transferred, or redeemed, except as required by law.

8. Consumer Protection

  • Under the Consumer Protection Act, 2019, you have rights to fair treatment, accurate information, and redressal for unfair practices.

9. Governing Law and Dispute Resolution

  • Governing Law: These CloudSave Coins Terms are governed by the laws of the State of Maharashtra, India, without regard to conflict of law principles.
  • Dispute Resolution: Disputes arising from this policy will be resolved through binding arbitration in Mumbai, in accordance with the Arbitration and Conciliation Act, 1996, conducted by a single arbitrator in English, except for matters eligible for consumer courts under the Consumer Protection Act, 2019.

10. Changes to These Terms

  • We may update these CloudSave Coins Terms to reflect changes in our practices, platform requirements, or legal obligations.
  • It is your responsibility to review these terms periodically for updates by visiting the CloudSave website or app. Continued use of Coins after changes constitutes acceptance of the updated terms.
