CloudSave Channel Policy

Axsa Technologies (“we,” “us,” or “our”), an Indian company headquartered in Mumbai, Maharashtra, India, operates CloudSave, a cloud storage and content-sharing platform. This Channel Policy governs the creation, management, and usage of channels within CloudSave, enabling users to broadcast or share content, such as files, media, documents, or messages, with subscribers. By creating or using a channel, you agree to comply with this Channel Policy, as well as our Terms of Service, Privacy Policy, Auto-Renewal Agreement, CloudSave Coins Terms, Refund Policy, Monetization Policy, and DMCA Policy.

1. Overview of Channels

  • Purpose: Channels allow users to share content with subscribers, functioning similarly to social media or messaging platforms. Channels can be public (accessible to all CloudSave users) or private (restricted to approved subscribers).
  • Content Scope: Users may broadcast or share a broad range of lawful content, including educational, entertainment, professional, creative, or personal material, subject to the restrictions outlined in this policy.
  • Monetization: Eligible channels may participate in the monetization program to earn revenue, as detailed in Section 4 and our Monetization Policy.

2. Channel Creation and Management

  • Creation: Registered CloudSave users can create channels through the CloudSave app or website by providing a channel name and optional description or settings (e.g., public or private).
  • Moderation Responsibility: You are solely responsible for moderating your channel’s content, including posts, comments, and subscriber interactions, and ensuring compliance with this policy, our Terms of Service, and applicable laws.
  • Subscribers: You control access to private channels and may remove subscribers for violating channel rules. Public channels are open to all CloudSave users unless restricted by you.
  • Settings: You may configure channel settings, such as enabling/disabling comments, restricting posts, or requiring CloudSave Coins for premium content access.

3. Permitted Content

  • Broad Scope: You may share any lawful content that aligns with your channel’s purpose, including but not limited to tutorials, vlogs, music, artwork, documents, announcements, or community discussions, provided it complies with this policy and applicable laws.
  • Intellectual Property: You must own or have the necessary rights or permissions to share content (e.g., original creations or licensed material). Unauthorized use of copyrighted material is prohibited, as per our DMCA Policy.
  • Content Standards: Content must be appropriate, respectful, and compliant with Indian and international laws, avoiding harm, misinformation, or illegal activities.

4. Monetization Program

  • Eligibility: To participate in the monetization program, your channel must be at least 90 days old, have no active copyright claims, maintain at least 1,000 active subscribers, be linked to a premium/pro account, and comply with our Monetization Policy.
  • Revenue: Monetized channels may earn up to $10 USD per month based on factors such as subscriber location, engagement, and CloudSave Coin subscriptions, as outlined in our Monetization Policy.
  • Payouts: Earnings are processed monthly, subject to a $10 USD minimum threshold, applicable taxes (e.g., GST, TDS), and valid payment details (e.g., PAN, bank account, or UPI ID).
  • Termination: We may suspend or terminate monetization for violations of this policy or our Monetization Policy, with notice where feasible.

5. Prohibited Content and Activities

To ensure a safe, lawful, and respectful environment, the following content and activities are strictly prohibited on channels:

  • Illegal Content: Content that violates Indian or international laws, including:
    • Copyright infringement, as per the Indian Copyright Act, 1957 (e.g., unauthorized sharing of movies, music, or software).
    • Hate speech, defamation, or content promoting illegal activities.
    • Obscene or pornographic material, as prohibited under applicable Indian laws.
  • Harmful Behavior: Content that:
    • Promotes or encourages self-harm, suicide, or violence.
    • Discriminates against or harasses individuals based on race, gender, religion, caste, sexual orientation, disability, or other protected characteristics.
    • Exploits or endangers minors, including sharing inappropriate or explicit material.
  • Misinformation: False or misleading information that could cause harm, such as:
    • Health-related misinformation (e.g., unverified medical claims).
    • Election fraud claims or disinformation undermining democratic processes.
  • Spam and Scams: Activities involving:
    • Unsolicited messages or promotional content without subscriber consent.
    • Phishing, fraud, or deceptive schemes (e.g., fake giveaways or pyramid schemes).
  • Malicious Content: Content that:
    • Contains malware, viruses, or harmful code that could damage user devices or the Services.
    • Includes links to phishing sites or other harmful external resources.
  • Evading Restrictions: Actions to:
    • Create new channels to bypass suspensions, bans, or content removals imposed by CloudSave.
    • Use alternate accounts to circumvent moderation actions.
  • Impersonation: Misrepresenting your identity or impersonating individuals, organizations, or public figures to deceive subscribers.
  • Privacy Violations: Sharing personal or sensitive information of others (e.g., phone numbers, addresses, or financial details) without their explicit consent, in violation of the Digital Personal Data Protection Act, 2023 (DPDP Act).

6. Content Moderation and Enforcement

  • Monitoring: We reserve the right to monitor channels and content to ensure compliance with this policy, though we are not obligated to pre-screen all content.
  • Enforcement Actions: Violations may result in:
    • Removal of specific content or posts.
    • Suspension or termination of your channel.
    • Suspension or termination of your CloudSave account, as per our Terms of Service.
    • Withholding or forfeiture of monetization earnings for non-compliant channels.
  • Reporting: Users can report violating content via in-app reporting tools or by emailing [email protected]. We will investigate reports promptly and take appropriate action.
  • Appeals: If your content or channel is removed or suspended, you may appeal within 7 days by emailing [email protected] with details of the issue. We will review appeals and respond within 14 days.

7. Channel Subscriptions and CloudSave Coins

  • Premium Channels: You may offer premium content accessible via channel subscriptions, funded by CloudSave Coins, as per our Auto-Renewal Agreement and CloudSave Coins Terms.
  • Auto-Renewal: Channel subscriptions auto-renew monthly if the subscriber’s wallet has sufficient Coins; otherwise, the subscription lapses, requiring manual resubscription, as detailed in our Auto-Renewal Agreement.
  • Refunds: Coin deductions for channel subscriptions are generally non-refundable, except for technical errors or non-delivery of promised content, as per our Refund Policy.

8. Intellectual Property and DMCA Compliance

  • Your Responsibility: You must ensure all channel content complies with intellectual property laws. Unauthorized use of copyrighted material may result in content removal, channel suspension, or account termination, as per our DMCA Policy.
  • Claims: Copyright owners can file infringement claims with our Designated Copyright Agent, as outlined in the DMCA Policy. We may remove content and notify you of claims, with an opportunity to submit a counter-notification.

9. Privacy

  • Data Practices: Your use of channels is subject to our Privacy Policy, which governs the collection, use, and protection of personal data, including channel-related data (e.g., subscriber lists, engagement analytics).
  • Subscriber Privacy: You may not collect, store, or share subscribers’ personal data without their explicit consent or in violation of the DPDP Act.

10. Termination of Channels

  • By You: You may delete or deactivate your channel at any time via the app or website. Deleting a channel may result in the loss of subscriber data and content, subject to our data retention policies outlined in the Privacy Policy.
  • By Us: We may suspend or terminate your channel for violations of this policy, our Terms of Service, or applicable laws, with notice where feasible.
  • Effect: Termination ends subscriber access to your channel, and any CloudSave Coins in your wallet may be forfeited, as per the CloudSave Coins Terms.

11. Disclaimers and Liability

  • As-Is Basis: Channels are provided “as is” without warranties, express or implied, including merchantability or fitness for a particular purpose.
  • Liability Cap: As per our Terms of Service, our liability is limited to the greater of $20 USD or 100% of any amount you have paid under your current service plan (e.g., premium/pro subscription or Coin purchases) in the 12 months preceding a claim.
  • Content Responsibility: You are solely responsible for your channel’s content and any consequences arising from it.

12. Governing Law and Dispute Resolution

  • Governing Law: This Channel Policy is governed by the laws of the State of Maharashtra, India, without regard to conflict of law principles.
  • Dispute Resolution: Disputes will be resolved through binding arbitration in Mumbai, in accordance with the Arbitration and Conciliation Act, 1996, conducted by a single arbitrator in English, except for matters eligible for consumer courts under the Consumer Protection Act, 2019.

13. Changes to This Policy

  • We may update this Channel Policy to reflect changes in our practices, platform requirements, or legal obligations.
  • It is your responsibility to review this policy periodically for updates by visiting the CloudSave website or app. Continued use of channels after changes constitutes acceptance of the updated policy.

14. Consumer Protection

  • Under the Consumer Protection Act, 2019, you have rights to fair treatment, accurate information, and redressal for unfair practices.
